General points
1.1. These terms and conditions of sale (hereinafter "T&Cs") govern the contractual relationships between Visuals Switzerland SA and its customers.
1.2. Any deviation from these T&Cs must be subject to prior written agreement from Visuals Switzerland SA.
Offer
2.1. The offers published on Visuals Switzerland SA's online shop are non-binding. Only the order confirmation sent by email or the delivery is binding.
2.2. Product information, images, technical specifications and accessory links are provided without guarantee. Only the manufacturer's data at the time of delivery is binding.
2.3. Visuals Switzerland SA disclaims any responsibility for the content of linked external websites.
Prices
3.1. All prices are expressed in Swiss francs (CHF), excluding VAT.
3.2. Additional costs (shipping, packaging, payment fees) are indicated separately.
3.3. The applicable prices are those in effect on the date of the order.
3.4. Subject to technical modifications, errors and misprints.
3.5. Visuals Switzerland SA reserves the right to change its prices at any time without notice.
3.6. Consulting or technical assistance services are not included in the prices.
Payment methods
4.1. Accepted: advance payment, credit and debit cards, invoice (subject to conditions and prior agreement), instalment payment (subject to conditions and prior agreement).
4.2. For card payments, the debit occurs at the time of order. Data is transmitted in encrypted form.
4.3. Invoices are payable within 30 calendar days. (payment granted subject to conditions)
4.4. Reminder fees may be charged.
4.5. In case of non-payment in advance within 5 days, Visuals Switzerland SA may cancel the order.
4.6. Visuals Switzerland SA may perform solvency checks and limit payment methods without justification.
Payment and retention of title
5.1. In case of late payment, deliveries may be suspended.
5.2. In case of non-payment despite reminders, Visuals Switzerland SA may use a debt collection agency.
5.3. Surcharges may be applied depending on the payment method.
5.4. Interest may be charged on instalment payments.
5.5. The goods remain the property of Visuals Switzerland SA until full payment is made.
Delivery
6.1. Orders are confirmed by email.
6.2. Delivery times are indicative. In case of delay, the customer may cancel after a written additional period of 60 days. No compensation is due.
6.3. Visuals Switzerland SA may cancel an order for reasons beyond its control.
6.4. Partial deliveries are possible.
6.5. Delivery is generally made to the kerbside. Transport may be provided by several service providers.
6.6. Visuals Switzerland SA does not take back old devices.
Transport and damages
7.1. The goods are insured during transport.
7.2. The customer must check the delivery within 5 days and report any damage.
7.3. Original packaging must be kept.
Returns, exchanges and refunds
8.1. No right of return is granted, except with prior written agreement.
8.2. If accepted, an RMA number and return address are provided.
8.3. Returns must be complete, in the original packaging and accompanied by proof of purchase. Costs are borne by the customer.
8.4. Unauthorised returns may be refused and charged.
8.5. Any incomplete or incorrectly addressed return may be sent back at the customer's expense.
8.6. Refunds, if accepted, are made within 10 days or in the form of a credit valid for one year.
Original packaging
9.1. The original packaging should be kept whenever possible. It is required in case of repair.
Warranty
10.1. The manufacturer's warranties apply, except for mandatory provisions of Swiss law.
10.2. The delivery note serves as a warranty certificate.
10.3. The warranty is limited to repair or replacement. Not covered: wear and tear, impacts, moisture, software, unauthorised interventions, wear parts, batteries, lamps, casings.
10.4. The warranty does not cover on-site service. Replaced parts become the property of Visuals. The exchange does not extend the initial warranty period.
Repairs
11.1. Repair requests must be addressed to Visuals Switzerland SA.
11.2. Items must be sent or brought with their accessories and in suitable packaging. Shipping costs are the responsibility of the customer.
Applicable law and jurisdiction
12.1. Swiss law applies exclusively.
12.2. The legal jurisdiction is Geneva, within the limits permitted by law.
Personal data
13.1. Visuals Switzerland SA processes personal data in accordance with the Federal Data Protection Act (DPA). See privacy policy on our website.
Limitation of liability
14.1. To the extent permitted by law, Visuals Switzerland SA disclaims any liability for indirect damages, data loss or loss of profit.
